1. Agreement

These Terms of Service (“Terms”) govern your use of EmailSleuth, operated by Caspar de Roij, trading as “Email Sleuth” (ABN 78743223667) (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Email Sleuth inspects email addresses and message content submitted through your website forms and returns a spam/validity verdict, combining syntax, domain, mailbox-verification, and content-pattern checks. We provide a dashboard, an API, and a WordPress plugin to access it.

3. Eligibility & Accounts

You must be at least 18 and able to form a binding contract. You are responsible for activity under your account and for keeping your credentials and API keys secure. Notify us promptly of any unauthorised use.

4. Acceptable Use

You agree not to:

  • Use the Service unlawfully, or to violate anyone’s privacy or rights.
  • Submit personal information (including third parties’ email addresses) without a lawful basis to do so. You are responsible for your compliance with applicable privacy laws when submitting data for checking.
  • Resell, redistribute, or build a competing verification service from the results.
  • Attempt to disrupt, reverse-engineer, scrape, or circumvent the Service, its limits, or its security.
  • Use the Service to send spam or to facilitate deception.

5. Plans, Credits & Billing

  • Paid plans are billed in advance through Stripe on a monthly or annual basis.
  • Each plan includes a monthly allowance of checks (“credits”) that resets each billing period. Unused monthly credits do not roll over.
  • Top-up credits can be purchased separately, never expire, and are used only after your monthly allowance is exhausted.
  • Prices are in US dollars and exclude any taxes (including GST) unless stated. You are responsible for applicable taxes.
  • We may change prices or plan features with reasonable notice; changes take effect at your next billing period.

6. Cancellation & Refunds

You can cancel at any time from your dashboard; your plan remains active until the end of the current billing period, after which it will not renew. Except where required by law, payments are non-refundable and we do not provide refunds for partial periods or unused credits.

Nothing in these Terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded.

7. API Keys & The Wordpress Plugin

We grant you a limited, non-exclusive, non-transferable licence to use the API and plugin to access the Service. API keys are issued per website and must be kept confidential; you are responsible for checks made with your keys.

8. Your Data & Privacy

Our handling of personal information is described in our Privacy Policy. For the emails you submit for checking, you are the controller and we act as your processor. You retain ownership of your data; you grant us the rights necessary to provide the Service.

9. Availability & Changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation, and we may modify or discontinue features. We are not liable for downtime of third-party providers (such as MillionVerifier or Stripe).

10. Disclaimers

Email verification is probabilistic, not guaranteed — a verdict is our best assessment and may be wrong. You are responsible for how you act on verdicts. To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. This does not limit any non-excludable consumer guarantees.

11. Limitation Of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential loss, or loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Where liability cannot be excluded (such as under the Australian Consumer Law), our liability is limited, at our option, to re-supplying the Service or paying the cost of re-supply.

12. Indemnity

You agree to indemnify us against claims and losses arising from your breach of these Terms, your misuse of the Service, or your submission of data without a lawful basis.

13. Suspension & Termination

We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. You may close your account at any time from Settings; closing your account cancels your subscription, revokes your API keys, and erases your data as described in the Privacy Policy.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of its courts.

15. Changes To These Terms

We may update these Terms from time to time. Material changes will be notified via the dashboard or by email, and the “Last updated” date will change. Continued use after changes take effect means you accept them.
